When something happens and a person is being accused of having committed a crime against someone, that person has a number of options on how to face the charge. One of the most commonly used options is the deferred adjudication.

Agreement on the plea bargain

The kind of plea bargain that is done between the side of the criminal court and that of the person who is accused of a crime is a deferred adjudication. In layman’s terms, the deferred adjudication is the act of postponing to a later date the announcement of the final verdict. This does not necessarily mean an expunction of criminal records will occur.

And in order for a defendant to have this opportunity, he or she has to plead no contest or guilty. However, the effect is that the defendant seems to be admitting the crime. When the defendant asks for deferred adjudication, his or her background is going to be checked for previous convictions or arrests, and if they do not find anything, then he or she has a better chance at being granted it.

The two components of a criminal charge

It all depends upon the weight of the charges made against the person, but usually, the judge will give out the chance to complete alcohol classes or community service upon receipt of deferred adjudication. And then eventually, as long as the defendant does as the judge commanded, the charges against him or her will be dismissed. This may or may not mean that this will expunge criminal records you might have against you.

Of course a conviction is not visible on public records; however, there are a couple of parts of the criminal charge that will be visible to people who do background checks. Those things include the documents that were created about the arrest, and those documents usually involve pictures, notes by police officers, statements from witnesses, and others. The other one is the deferred adjudication that is granted or not by the court. People have the capability and the access to see that a person had asked for deferred adjudication and plead no contest to the charge or guilty.

Having a record that is sealed from the public

First of all, you have to be aware that not everything about a criminal charge can be completely sealed, but you can seal most of it through filing for an Order of Non-Disclosure. If the order is granted, you will be able to rest assured that the public will not be able to access documents about the charge. The time that is needed for the sealing of your record is not fixed, because it merely depends on how many people filed the same and the case. Usually, though, it is done in a few months.

A Deferred Adjudication Does Not Clear Your Record

But you have to remember that because sealing your records does not mean erasing your records, a previous charge can be reopened if you are prosecuted in the future. A lawyer with vast experience will be able to help you in a case so that you would be aware of all the options that you may take. Also, a good and experienced lawyer will also be able to help you make those decisions that are the best for your future, not just for the case that you are facing in the present.
